Child Safety Seats Thursday, November 26, 2009 Article Read 28 Times
Rochester, N.Y. - A new law went into effect Tuesday, requiring children to remain in a safety restraint for an extra year.
Most little kids can't wait to be big kids, and for some, that means leaving their car seats behind. But some will have to put that off for one more year.
Traffic Safety Specialist Jean Triest said, “It's actually not a new law, just a change to an existing law. The law is stating now that a child has to stay in a booster seat or in an appropriate restraint up until his or her 8th birthday. Previously it was their 7th birthday."
For children who are younger than 8, but taller than 4’ 9”, or heavier than 100 pounds, there is an exemption. If that child is not wearing a safety restraint, the driver would still get the ticket from the officer, but then when in court, it would be dismissed. That is called an affirmative defense.
There are two main types of booster seats -- a high back and a no-back.
Experts say one type of safety seat that should not be used anymore is one that has a shield on the front.
Also, safety seats have a lifespan. This is because plastics can break down and no longer protect the child in a crash.
Triest said keeping your child in a booster seat as long as his or her size will allow it, is the best thing to do. The fine for not doing so can be up to $100.
